1. Eligibility

You must be at least 18 years old and able to form a binding contract to place an order. Orders placed on behalf of a business must be placed by someone authorized to bind that business.

2. Account

You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use.

3. Product information, colors, and availability

• We work hard to keep product descriptions, dimensions, and images accurate but do not warrant that they are error-free.
• Cabinet colors on your screen will differ from the physical product. We strongly recommend ordering a sample before committing to a large order — differences in monitor calibration, ambient light, and finish sheen are not defects.
• All products are subject to availability. We reserve the right to limit quantities and to discontinue any product at any time.

4. Pricing and taxes

• All prices are in U.S. dollars and are subject to change without notice.
• We reserve the right to correct pricing errors at any time, including after an order has been placed. If we correct a price on an order you have placed, we will contact you and either honor the original price, cancel the order for a full refund, or accept your consent to the corrected price before proceeding.
• Sales tax is calculated at checkout based on the ship-to address.

5. Order acceptance

Your order is an offer to buy, not a completed sale. We accept your order when we send an order-confirmation email and the payment successfully clears. We may decline or cancel any order at our discretion — for example, if we suspect fraud, if a product is out of stock, or if we cannot deliver to your address.

6. Payment

You authorize us and our payment processors to charge your chosen payment method for the full amount of your order, including applicable taxes and shipping. You represent that any payment method you provide is yours or that you have authorization to use it.

7. Shipping, returns, and warranty

Shipping is governed by our shipping policy, returns by our return policy, and warranty coverage by our limited warranty. Those policies are incorporated into these terms by reference.

8. Promotions, coupons, and discount codes

• Unless expressly stated, promotional codes cannot be combined with any other offer, trade discount, or verified-profession discount.
• Codes have no cash value, are non-transferable, and cannot be applied retroactively to prior orders.
• We reserve the right to cancel any promotion at any time.

9. Acceptable use

You agree not to:

• Use the site for any unlawful purpose or in violation of these terms.
• Attempt to gain unauthorized access to the site, its servers, or any related systems.
• Scrape, mirror, or otherwise copy site content without our written permission.
• Upload or transmit viruses, malware, or any harmful code.

10. Intellectual property

All content on modcabs.com — including text, photography, product renderings, logos, and code — is owned by Distinct Kitchen & Bath LLC or its licensors and is protected by U.S. and international copyright and trademark law. You may not reproduce or distribute any content without prior written permission.

11. Disclaimer of warranties

Except for the express limited 5-year warranty on our cabinets, the site and all products are provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the fullest extent permitted by law, Mod Cabs’s and Distinct Kitchen & Bath LLC’s total liability for any claim arising out of or relating to a product or the site is limited to the amount you paid for the product giving rise to the claim. In no event will we be liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, lost use, loss of data, or contractor scheduling costs — even if we have been advised of the possibility of such damages.

13. Indemnification

You agree to indemnify and hold Distinct Kitchen & Bath LLC, its affiliates, officers, employees, and agents harmless from any claim or demand — including reasonable attorneys’ fees — arising out of your breach of these terms or your violation of any law or third-party right.

14. Governing law and venue

These terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising under these terms shall be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts.

15. Changes to these terms

We may update these terms at any time. The updated version will be posted on this page with a new effective date. Continued use of the site after changes are posted constitutes acceptance of the updated terms.
